미국의 부동산권리와 등기제도
법제의 통일화 요청이 있는 계약법 영역과는 달리 부동산 등 기제도와 같은 물권법은 각국의 관습과 전통에 기반을 두고 규 율되고 있다는 점에서 영미의 등기제도는 우리나라와는 본질적 으로 차이가 많은 부분이 있다. 이에 따라 종래 우리 법제에서 의 등기제도에 관한 연구는 영미법계의 부동산 등기제도에 대 해서는 관심이 덜하였던 것이 사실이다. 그러나 우리나라와 미 국의 상호관계와 그 밀접성을 고려할 때 미국의 법제에 대한 연구의 중요성과 지속적인 관심의 필요성은 다른 법제에의 비 교연구에 비해 결코 뒤처지지 않는다고 할 것이다. 또한, 해외 부동산 취득의 관심 증가에 따라 미국에 거주하는 우리 교민을 비롯하여 국내 거주자인 우리 국민의 재산권 보호의 필요성을 고려할 때에, 미국의 부동산법제에 대한 이해의 필요성이 있다. 다만, 미국에서의 부동산 권리의 내용으로서 소유 또는 소유 권에 관한 개념은 우리의 법제와 상당히 다를 뿐만 아니라 그 유형이 세분화되어 있으며, 또한 연방제 국가인 이유로 각 주 (州)마다의 부동산에 관한 입법이 다양하여, 미국 전체의 부동 산법제의 일반론을 도출하는 것도 쉽지 않다. 뿐만아니라, 미국 의 부동산등기제도는 우리나라의 부동산등기제도가 모범으로 삼았던 독일, 프랑스의 제도와는 달리 미정비 상태에 있는 부분 이 많은 반면 이에 따라 독특한 발전을 이루고 있다는 특징이 있다. 미국 부동산등기제도의 중심을 이루는 것은 증서등록제도 (Recording System)이다. 이 제도의 기원은 미국 식민지 시대 로 거슬러 올라갈 수 있으며 공시제도로서는 전근대적인 것이 라 할 수 있어 많은 결점을 가지고 있다. 미국과 같은 고도로 발달한 자본주의 국가에서 이러한 전근대적 제도가 계속되고 있다는 것 자체가 의외이지만, 이를 지속하게 해주는 가장 큰 이유로 부동산 권원보험(Title Insurance)의 존재를 들 수 있 다. 그러나 부동산 권원보험은 증서등록제도의 결함을 근본적으 로 해결하는 것이 아니라 미봉책에 불과하며, 부동산 권원보험 이 보급될수록 증서등록제도의 근본적인 개선이 어려워져 미국 부동산등기제도의 근대화는 멀어지게 되는 딜레마에 빠지게 된 다는 문제도 있다. 본고에서는 미국 부동산등기제도에 관한 특징을 이해하기 위 해, 미국에서의 부동산의 개념 및 부동산권리에 관한 유형을 검 토하고, 부동산 거래의 과정에서의 부동산 양도증서의 등록과정 에 대하여 검토하였다.
The Estates and Recording System in the US
Real rights laws such as the real estate registration system are regulated based on the customs and traditions of each country. In this respect, the British-American registration system is essentially different from Korea. Accordingly, it is true that there was less interest in the real estate registration system of the British and American in the past. There is a great need to understand the U.S. real estate legislation in that interest in overseas real estate is increasing and the need for protection of Korean residents is requested. However, the concept of ownership or ownership as the content of real estate rights in the United States is not only quite different from our legislation, but its type is subdivided. The center of the U.S. real estate registration system is the Recording System. The role of the U.S. ‘Recording System’, which contains the registration of ‘deed’, is to stabilize and clarify rights relations. It can be said that the purpose and function of the registration system in Korea are similar. In this paper, in order to understand the characteristics of the US real estate registration system, the concept of real estate in the United States and the type of real estate rights were reviewed. In addition, the registration of ‘deed’ in the process of real estate transactions was reviewed.
