제주4·3사건 진상규명 및 희생자 명예회복에 관한 특별법상 유족의 범위에 대한 검토
제주4·3사건은 1947년 3·1절 발포사건과 1948년 4월 3일 무 장봉기로 촉발되어, 무장대와 토벌대 간의 무력 충돌과 토벌대 의 진압과정에서 가옥 4만여 채를 비롯해 마을 전체가 폐허가 된 경우도 있었다. 특별법의 제정은 무엇보다도 그 제정 목적에 부합해야 하며, 제정 배경, 즉 제정의 원인이 되는 사건이나 목 적에 대한 이해가 전제되어야 한다. 4·3사건법의 제정 배경 및 제정 목적을 고려한다면, 유족의 범위를 한정함으로써 보상에서 배제되는 자가 되도록 없도록 하는 것이 이에 부합한다고 볼 수 있을 것이다. 더구나 제주4·3사건 발생 이후 약 70년이라는 시간이 지난 현시점에서야 실질적인 보상이 시작되었다는 점을 이해한다면 유족으로 인정될 수 있는 대상을 제한하는 것은 해 당 법의 제정 목적에 맞지 않는다. 따라서 4·3사건법의 유족의 범위를 8촌 이내의 혈족까지 그 범위를 확대하는 것이 제정 목 적에 더 부합한다는 점에서 찾을 수 있다.
Review of the scope of bereaved family according to the Jeju 4·3 Incident Act
The Jeju 4·3 Incident was triggered by the firing of March 1, 1947 and the armed uprising on April 3, 1948., the destruction of various industrial facilities and the loss of buildings of public institutions such as schools and myeon offices, as well as about 40,000 houses, and in some cases the entire village was in ruins. The establishment of a special law must conform to the purpose of the establishment above all, and must be premised on the background of the establishment, that is, the understanding of the case or background that causes the establishment. Considering the background and purpose of the establishment of the 4·3 Incident Act, it would be appropriate to limit the scope of the bereaved family so that no one is excluded from compensation as much as possible. Moreover, if it is understood that the actual compensation started at this point, about 70 years after the Jeju 4·3 incident, it is not suitable for the purpose of enacting the law to limit the subjects that can be recognized as survivors. Therefore, it seems that the grounds for expanding the scope of the bereaved family to the eighth degree are substantial.
