중화인민공화국 민법전의 제정의의 및 민법총칙의 주요 내용
2020년5월28일 제13회전국인민대표대회제3차회의에서 제 정된 중국의 “중화인민공화국 민법전”은 총칙(总则)·물권(物权)· 계약(合同)·인격권(人格权)·혼인가정(婚姻家庭)·상속(继承)·권리 침해(侵权责任)의 총7편 1260개 조문으로 이루어져 있으며 2021년1월1일부터 시행하고 있다. 이 민법전은 통상적으로 민 법이 규율하는 범위가 사적 생활관계의 거의 대부분에 미치고 있다는 점을 강조하여 “생활백과전서”라고도 불리고 있다. 후자 의 경우 1949년 이래 1954년·1962년·1979년과 1998년의 총 네 차례에 걸쳐 시도되었던 민법전 제정 작업이 무산된 후 2020년 비로소 제정된 것으로 이른바 “신중국” 최초의 민법전 이다. 더욱이 시진핑의 “중국 특색의 사회주의” 법체계에 의한 법치를 강조하고 있는 국면에서 이루어진 것이라서 이에 대한 중국 사회의 반향은 매우 뜨겁다. 때문에 중국과의 관계를 소홀 히 할 수 없는 한국에게서 있어서도 중국의 민법전의 제정과 시행은 주목하지 않을 수 없는 중요한 사건이다. 이에 본문은 그 제정의 역사적 경과와 구조 그리고 “총칙”의 주요내용에 대 해 검토해 보았다.
Legislation intent for the Civil Code of People’s Republic of China and the Main Contents of the General Rules
The “Civil Code of the People's Republic of China”, which was enacted at the 3rd meeting of the 13th National People's Congress in China on May 28, 2020, consists of seven Parts and 1260 Articles of general provisions, real rights, contracts, personal rights, marriage and family, inheritance, infringement of rights, and is in effect from January 1, 2021. Considering that the scope governed by the Civil Code extends to almost all of the private life relations, this Civil Code is also referred to as the “Encyclopedia of Life”. In China, the Civil Code was enacted in 2020 after the four attempts to enact the Civil Code from 1949 to 1954, 1962, 1979 and 1998 were defeated, and it is the first civil code of the so-called "New China". Moreover, since it was made in a phase where Xi Jinping's “socialist legal system with Chinese characteristics” emphasized the rule of law, Chinese society's reaction to this was very hot. Therefore, even in Korea, where relations with China cannot be neglected, the enactment and enforcement of China's Civil Code is an important event that cannot but be paid attention. Therefore, this thesis is reviewing the historical progress and structure of its enactment and the main contents of the “general rules”.
