대학교수의 업무상저작물에 관한 연구 - 각 대학의 지식재산권 규정을 중심으로 -
이 연구는 대학교수의 저작물이 업무상저작물에 해당하는지, 업무상저작물에 대한 귄리 귀속 및 보상에 관한 관련법의 논의를 토대로 업무상저작물에 관한 대학의 지식재산권 관련 규정을 검토하고 개선방안을 제시하는 데 그 목적이 있다. 대학교수의 직무상․업무상 창작물인 직무발명이나 업무상저작물은 양자 모두 고용계약 등에 의해 사용자의 업무에 종사하는 자가 그 직무상 창작한 산물에 대해서 실제로 창작행위를 완성한 종업원과 그 창작물 완성을 위해 물적‧인적 지원을 한 사용자의 이익을 균형있게 고려하여 일정한 요건하에 그 권리를 사용자에게 귀속시키는 측면에서는 그 취지가 동일하다고는 하나, 그 요건 및 권리귀속, 보상관계 등에서는 상당한 차이가 있다. 그럼에도 불구하고 그러한 차이를 고려함이 없이 대학의 지식재산권 관련 규정에서는 직무발명에 대한 규정을 업무상저작물에도 적용한다는 추상적인 규정만을 두고 있고, 이를 적용하는 과정에서 논란이 발생하고 있다. 해결책으로서는 저작권법 등 관련법의 논의를 바탕으로 대학의 지식재산권 관련 규정을 개정하는 것이고, 그 개정안으로 대학교수의 저작물을 업무상저작물과 업무상저작물 이외의 저작물로 구별한 정의규정, 업무상저작물 및 업무상저작물 이외의 저작물에 대한 권리귀속관계, 보상청구권, 수익분배 등을 명확히 하는 규정을 둘 것을 제안하였다.
A Study on the Works Made For Hire of university professors - focusing on intellectual property regulations of several university
The purpose of this study is to review intellectual property regulations of several university on the works made for hire based on the discussion of related laws. The legislation purpose of a professor's employee inventions and works made for hire is the same in terms of attributing the rights to the employer in consideration of the interests of employees and employers. However, there are significant differences in the requirements, rights attribution, and compensation relationships. Nonetheless, several university's intellectual property regulations only have abstract provisions that apply the rules for employee inventions to works made for hire. As a solution, I propose to amend the regulations on intellectual property rights of several university. In other words, it defines the definition of regulations distinguished between works made for hire and other than works made for hire, and clearly defines the rights attribution, compensation relationships, profit distribution etc.
