「장사 등에 관한 법률」에 대한 민사법적 고찰 - 연고자 개념과 묘지 사전 매매 금지 및 분묘기지권에 대하여 -
장사법상 연고자란 시신이나 분묘 등을 수호하거나 관리 및 처분할 수 있는 권리와 이와 관련된 일정한 의무를 지닌 자를 지칭한다. 한편 분묘의 수호 ․ 관리와 제사주재자에 관련된 대법원 판결의 의미를 종합적으로 파악해보면, 분묘의 수호 ․ 관리와 그 시신과 분묘는 특별한 사정이 없는 한 제사주재자인 망인의 장남에게 귀속된다고 볼 수 있다. 그러나 장사법은 연고자의 순위를 규정하고 있으므로 장사법이 적용되는 사안에 한해서는 적어도 대법원 판례가 제시하고 있는 제사주재자 결정방법은 무의미한 것으로 보여진다. 장사법 제21조를 개정한다면, ‘임대 ․ 사용계약’에서 ‘임대’를 삭제하고, 임대차와 사용대차 모두를 포함할 수 있는 ‘사용계약’만을 규정하든지, 또는 ‘임대차 ․ 사용대차’라고 규정하는 것이 적확할 것이다. 그리고 장사법 제21조의 묘지의 사전 매매 금지 규정은 강행규정이며, 특히 효력규정으로 파악하여 이를 위반한 사법상 효력까지도 무효화 시키는 것이 타당할 것이다. 분묘기지권의 시효취득을 인정하는 종전의 관습은 장사법이 시행된 2001년 1월 13일에 그 의미를 상실하였다고 보아야 할 것이므로, 이 시점 이후에는 종전의 관습을 가지고 취득시효에 의한 분묘기지권을 주장할 수 없다고 본다.
Civil Law Study on Act on Funeral Services, Etc.
This paper analyzes the civil law problems that may be raised in Act on Funeral Services, Etc. and suggests solutions. The Act on Funeral Services, Etc., defines the meaning of “relative” and prohibition on the selling, transferring, leasing or contracting to use a lot in such cemetery prior to the death of a person to be buried in such lot. A contract that violates this rule should be considered invalid. The term ‘relative’ of Act on Funeral Services, Etc. means a person who is in any of the following relationships with the dead, and shall exercise his/her rights and duties in the following order: Provided, That where at least two children or lineal descendants are in the same order of priority, the closest and most senior relative shall have priority: (a) Spouse; (b) Children; (c) Parents; (d) Lineal descendants, except children; (e) Lineal ascendants, except parents; (f) Brothers and sisters etc,, As above, the Act on Funeral Services, Etc. defines the order of relatives. Therefore, at least in the case of Act on Funeral Services, Etc., the method of determining the ancestor worship supervisor of the Supreme Court case seems to be meaningless.
