판결에 의하여 확정된 채권의 재판상 청구와 시효중단 - 대법원 2018. 7. 19. 선고 2018다22008 전원합의체 판결을 중심으로 -
세계적으로 급변하는 시대의 흐름에 맞게 소멸시효제도를 현대화하고 있다. 그러나 우리 나라에서는 소멸시효제도를 입법적으로 현대화하지 못하고 있다. 그런데 최근 소멸시효와 관련된 대법원 전원합의체 판결이 선고되어 세간의 주목을 받고 있다. 먼저 일제 강점기 징용 피해자들의 손해배상청구권의 소멸시효를 부정한 판결, 판결에 의하여 확정된 채권의 시효 중단을 위한 재판상 청구 인정 판결과 시효중단을 위한 재판상 청구의 형태에 관한 판결이다. 본고에서는 두 번째 판결을 중심으로 그 판결의 타당성을 검토하였다. 구체적으로 반대견해에서 판결에 의하여 확정된 채권의 재판상 청구를 부정하는 근거로 제시하는 소멸시효제도의 취지, 승소판결 후의 재판상 청구 부정 및 소멸시효제도에 관한 관점의 변화에 대하여 검토하였다. 그 결과 소멸시효제도는 권리자의 권리불행사 상태가 일정한 기간 계속되는 경우 법률관계의 안정을 위하여 권리를 소멸시키는 예외적인 제도이다. 따라서 판결에 의하여 확정된 채권의 시효중단을 위한 재판상 청구는 진정한 권리자 보호를 위하여 허용하는 것이 타당하다.
Trial claim of bond fixed by judgment and Suspension of prescription
The system of extinctive prescription is being modernized in line with the rapidly changing times around the world. In our country, however, the system has not been modernized. The recent ruling by the Supreme Court on the extinctive prescription has drawn public attention. First of all is there a Judgment of denial of extinctive prescription the right to claim compensation for victims of Japanese colonial rule, a judgment to recognize a claim in order to stop the prescription of bonds fixed by judgment and a judgment on the Form of Trial Claims to Stop the Prescription. In this paper, the author examined the validity of the judgment based on the second judgment; specifically, the purpose of the extinctive prescription, the denial of trial after prescription and the change of perspectives on the extinctive prescription. As a result, the extinctive prescription system is an exceptional system in which the rights are extinguished for the sake of the stability of the legal relationship if the rights are not exercised for a certain period of time. Therefore, it is reasonable to allow a trial claim for the suspension of the bond fixed by a judgment to protect the true owner.
