공연, 방송 등에서의 출연계약
출연계약은 민법상 전형계약의 하나인 고용계약에 포섭되거나 고용계약에 가까운 비전형계약으로서 고용계약에 관한 규정이 직접 또는 유추적용될 수 있다고 본다. 다만 출연계약이라는 명칭을 지닌 계약이더라도 그 중 고용계약에 포섭되지 않거나 고용계약에 가까운 비전형계약이 아닌 성질의 계약들은 다른 전형계약 또는 비전형계약인 것으로 보아야 할 것이다. 그리고 출연계약은 기본적으로 고용계약으로 이해된다면, 근로기준법 등의 노동법 규정들이 우선 적용되고, 보충적으로 민법의 고용계약에 관한 규정들이 적용된다고 보아야 할 것이다. 결국 이와 같이 출연계약에 의한 노무제공자인 출연자 등은 근로기준법 등의 노동법에 의한 보호대상으로 편입될 여지가 더욱 넓어질 것이다. 연예인의 임금채권의 보호를 위해서 뿐만 아니라, 종래 단기소멸시효기간을 3년과 1년으로 정하고 있는 합리적인 구별 근거를 찾을 수 없는 현재의 시점에서는 이들 단기소멸시효기간 규정을 삭제하는 것이 바람직할 것이다. 그리고 미성년자의 연예기획사 전속계약이나 출연계약은 근로기준법의 적용을 받는 근로계약에 해당하므로, 친권자나 후견인이 대리할 수는 없고, 미성년자 본인이 친권자나 후견인의 동의를 얻어서 직접 계약을 체결하여야 한다. 또한 미성년자의 연예기획사 전속계약이나 출연계약이 유효하게 성립되더다도 그 근로계약이 미성년자에게 불리하다고 인정될 때에는 법정대리인 또는 고용노동부장관은 이를 해지할 수도 있다.
The Appearance Contract for Performance and Broadcasting
An appearance contract falls under the purview of the employment contract or is similar to the employment contract. Thus the regulation of employment contract can apply to an appearance contract directly or indirectly. If an appearance contract is the employment contract in principle, Labor Standards Act applies first and the regulation of employment contract of the Civil Law applies complementally. Eventually, like this, the players(labor providers) by an appearance contract is easy to go into the object of protection on labor law. The extinctive prescription period on claim for wages of entertainer should be eliminated for protection of claim for wages of entertainer. And the regulation on the extinctive prescription period on claim for wages of entertainer don’t have reasonable grounds of discrimination. An appearance contract of minor belongs to employment contract that ie subject to Labor Standards Act. Therefore the person with parental rights or guardian can’t subrogate conclusion of employment contract and minor should make an employment contract directly with agreement of the person with parental rights or guardian. If an appearance contract of minor is established efficiently but this contract goes against minor, a legal representative or the Secretary of Labor secretary can cancel this contract.
