사찰의 개념과 법적 성격
현행법 하에서 사찰의 개념과 그 법적 성격은 법해석론을 통해서 정해지게 되는데, 이때 전통종교로서 불교의 특성과 관습, 실제 운영형태 등이 중요하게 고려되어야 한다. 사찰은 종래 학설과 판례에 따라 이념적 요소로서 불교교의에 입각해서 불교양식에 따른 법요를 집행하고, 그 인적 요소로서 승려와 신도 그리고 물적 요소로서 불교시설을 갖춘 독립한 단체로서 공익성을 가진 단체에 해당한다. 그리고 불교의 사찰의 구성요소로서 신도나 신도회의 지위는 불교의 종교적 관점과 사찰운영과 관련한 관습 및 관행, 불교의 종단의 정체 등을 고려하여 판단해야 한다. 다음으로 사찰이 단체성을 갖추었는지 판단하기 위해서는 다양한 요소가 고려되어야 하겠지만, 기본적으로 사찰로서의 기본적인 구성요소를 갖추고 있다면 널리 그 단체성을 인정하는 방향으로 해석하는 것이 바람직하다. 마지막으로 사찰에서 그 물적 요소와 인적 요소의 불가분적이고 유기적인 연관관계를 고려할 때, 단체성을 가진 사찰은 법인격을 갖추지 않은 사단과 재단의 성격을 동시에 가지고 있는 특수한 단체로 파악하는 것이 타당하다. 다만 비법인특수단체로 보는 경우 사찰과 관련한 분쟁을 해결함에 있어서는 해당 사찰이 사단과 재단의 성격 중 어떤 것을 갖추고 있는지를 살펴, 관련법을 유추적용할 수 있을 것이다.
The Legal Character of Buddhist Temple
Since there is almost no law about the Buddhist temple, the temple of the law problem, there must be determined through the interpretation of the law. Problems related to inspections, Buddhist characteristics, practices, there is a need to take into account the actual operation. Inspections in addition to the religious element, the human element, such as a medium and the laity, and will take place as physical elements such as full-size. Also added public interest of the temple must be considered as important. A pilgrim association in the temple is an important element, but its legal status is different depending on the termination and temples, it must be determined. Whether inspections organizations, must be determined through the actual operation form of inspection, the presence or absence of a subscription of termination, property relations, such as giving appointment and dismissal, shall be determined taking into account the various elements. Inspections has all the personality of the character of the Institute and the Foundation. Therefore, inspection is an organization must be a special corporation.
