피담보채권에 대한 비판적 검토

담보물권에서의 피담보채권에 관한 여러 문제들을 자세히 검토하면서 합리적인 해결방안과 개정안을 제시하였다. ① 담보물권에서의 피담보채권의 개념에 관해서는, 학설이 갈린다. 즉, 소수설은 원본채권을 의미한다고 하나, 다수설은 2가지의 의미로 파악한다. 이 논문에서는, 소수설과 다수설을 비판적으로 검토한 후, 피담보채권은 담보물권에 의하여 담보되는 채권이므로 법률이 각 담보물권에 의하여 담보되는 채권을 규정하는 경우에는 그 법률에 의하여 피담보채권의 의미 내지 범위가 정해진다(따라서 각 담보물권마다 그 피담보채권의 의미가 다를 수 있다)고 하였다. 그 밖에 저당권에서 제1의미의 피담보채권과 제2의미의 피담보채권을 논하는 주장도 살피고, 그 문제점들을 논하였다. ② 담보물권은 채권을 담보하는가? 아니면, 채무를 담보하는가? 민법은 질권에서는 채권을 담보한다고 규정하면서도(제329조), (근)저당권에서는 채무를 담보한다고 규정하기도 하고(제356조․제367조) 채권을 담보한다고 규정하기도 한다(제361조․제364조 등). 학설은 이에 관한 문제의식이나 근거 없이 혼용한다. 즉, 채권을 담보한다고 하기도 채무를 담보한다고 하기도 한다. 이 논문에서는, 이에 관한 입법례를 살핀 후에, 이 문제는 담보물권의 존속에서의 부종성(다수설은 수반성이라고 함) 등을 고려할 채권을 담보한다고 하는 것이 옳다는 사견을 제시하였다. 그리고 민법 제356조와 제357조에서의 “채무”는 채권으로 개정하는 것이 옳다고 하였다. ③ 민법 제334조에 관한 입법례를 살핀 후에, 민법 제334조에 관해서 자세하게 검토하였다. 그리고 민법 제334조의 개정안을 제시하였다. 민법 제334조 (피담보채권의 범위) 질권은 원본채권, 이자채권, 위약금채권, 질물의 보존비나 개량비의 채권, 채무불이행이나 질물의 숨은 하자로 인한 손해배상채권을 담보한다. 다만, 지연배상채권에서는 원본채권 변제기의 다음날부터의 1년분만을 담보한다. ④ 민법 제360조에 관한 입법례를 살핀 후에, 민법 제360조에 관해서 자세하게 검토하였다. 그리고 민법 제360조의 개정안을 제시하였다. 민법 제360조 (피담보채권의 범위) 저당권은 원본채권, 이자채권, 위약금채권, 채무불이행으로 인한 손해배상채권을 담보한다. 다만, 지연배상채권에서는 원본채권 변제기의 다음날부터의 1년분만을 담보한다. ⑤ 민법 제357조 제1항과 제2항에는 “채무”가 여러 번 나타난다. 이 각각의 채무는 채권을 의미하는데, 구체적으로 어떤 채권인지를 살폈다. 또한 정부의 2004년 민법개정안 제357조의 2에 관한 문제점을 살피고 그 개선방안을 제시하였다. 그리고 전세권에서의 피담보채권에 관해서도 살피면서, 민법 제334조를 유추적용하는 것이 옳다는 사견을 제시하였다. 그뿐만 아니라, 「가등기담보 등에 관한 법률」과 「동산․채권 등의 담보에 관한 법률」 및 「부동산등기법」에 있어서의 (피담보)채권들에 대해 간단하게 검토하였다.

A Critical Study on the Claim Secured

In this paper, I have reviewed several issues on claim secured of real right for security, and proposed solutions and amendments. And then Hereinafter, this real right for security is called security-right. And Civil Code means Korean Civil Code. ① What is claim secured? The theory is divided about this problem. The minority theory is that claim secured means principal claim. But the majority theory says that claim secured has two meanings. In this paper, I have reviewed this minority theory and majority theory critically. And then I advocated that the meaning or scope of claim secured is determined by the Act that stipulates on the claim secured. Therefore, each claim secured may have a different meaning. In addition, there is a view that divides meaning of claim secured into the first meaning and the second meaning. I think this view is unreasonable too. ② Does security-right secure claim or debt? Civil Code stipulates that security-right secures claim in the pledge(Article 329), but debt or claim in mortgage and floating sum mortgage(Article 356․357․361․364 etc.). The theory says debt or claim without any grounds. After examining the legislative cases in detail, I advocated that security-right secure claim because that security-right is accompanied with claim. And it is right amend debt to claim in Civil Code Article 356․357. ③ After examining the legislative cases concerning Civil Code Article 334 in detail, I studied on Civil Code Article 334 in depth. And I put forward an reasonable amendment of Civil Code Article 334. ④ After examining the legislative cases concerning Civil Code Article 360 in detail, I studied on Civil Code Article 360 in depth. And I put forward an reasonable amendment of Civil Code Article 360. ⑤ Civil Code Article 360 Clause 1 and Clause 2 show “debt” several times. This debt means claim. I examined what kind of clain is this claim. And I examined problems in Civil Code Amendment Article 360-2 that our Government submitted the Assembly in 2004. And examining the claim secured in Chonsegwon, I advocated that it is right to apply Civil Code Article 334 to the scope of claim secured in Chonsegwon. And I examined simply the claims (secured) in Provisional Registration Security Act, Registration of Real Estate Act, and anther Act.
