분묘기지권에 관한 소고 - 대법원 2017. 1. 19. 선고 2013다17292 전원합의체 판결을 중심으로 -

주지하는 바와 같이 우리 민족은 유교문화와 풍수지리설의 강한 영향을 받아 명당을 찾아 조상의 분묘를 설치하고 이를 수호하는 조상숭배의 미풍양속을 가지고 있었으나, 정작 자신 소유의 산림을 소유하지 못한 대부분의 개인은 타인의 산림에 분묘를 설치할 수밖에 없었다. 이러한 이유로 설치된 기존의 분묘에 대하여 타인의 소유권에 기하여 그 분묘를 철거하거나 훼손하게 되면 사회적으로 큰 파장이 예상될 뿐만 아니라 우리의 오랜 관습 등 전통문화에도 역행하는 것으로 보아 그동안 판례는 일관하여 지상권 유사의 분묘기지권을 인정하여 분묘를 보호해 왔다. 그러나 2001. 1. 13.부터 시행된 ‘장사 등에 관한 법률’(이하 개정 전후를 불문하고 ‘장사법’이라 한다)에서는 법 시행 후 설치된 분묘에 관하여 분묘의 설치기간을 제한하고 분묘기지권의 시효취득을 인정하지 않는 내용의 규정을 두어 토지 소유권을 강화하는 등 묘지에 관한 법적 규율에 변화가 있었던 점, 분묘기지권이 토지 소유자의 소유권을 과도하게 제한하고 국토의 효율적 이용을 저해하는 측면이 있고, 화장률 증가 등 장사방법이나 장묘문화에 대한 전통적인 국민의식이 변화하고 있는 점 등으로 분묘기지권에 대한 사회 구성원들의 인식 변화와 함께 묘지에 관한 법제 등 전체 법질서의 변화로 인하여 분묘기지권의 시효취득에 관한 종래의 관습법이 더 이상 우리 법질서에 부합하지 않게 됨으로써 그 법적 효력을 유지할 수 없게 되었다고 보아야 한다. 백보를 양보하여도, 토지 소유자의 승낙이 없음에도 20년간 평온, 공연한 점유가 있었다는 사실만으로 사실상 영구적이고 무상인 분묘기지권의 시효취득을 인정하는 대상판결은, 무단 점유에 의한 소유권의 취득시효를 부정하는 대법원 전원합의체 판결과도 배치되는 모순을 범하고 있다. 따라서 토지 소유자의 승낙이 없음에도 20년간 평온, 공연한 점유가 있었다는 사실만으로 사실상 영구적이고 무상인 분묘기지권의 시효취득을 인정하는 종전의 관습은 적어도 2001. 1. 13. 장사법이 시행될 무렵에는 사유재산권을 존중하는 헌법을 비롯한 전체 법질서에 반하는 것으로서 정당성과 합리성을 상실하였을 뿐 아니라 이러한 관습의 법적 구속력에 대하여 우리 사회 구성원들이 확신을 가지지 않게 됨에 따라 법적 규범으로서 효력을 상실하였다. 그러므로 2001. 1. 13. 당시 아직 20년의 시효기간이 경과하지 아니한 분묘의 경우에는 법적 규범의 효력을 상실한 분묘기지권의 시효취득에 관한 종전의 관습을 가지고 분묘기지권의 시효취득을 주장할 수 없다고 보아야 하며, 이는 대상판결의 소수의견과 같은 견해이다. 본 논문을 통하여 판례의 조속한 변경을 기대해 본다.

A Study on the Right to a Graveyard

As we all know, our nation was influenced by the Confucian culture and the Feng Shui theory, and had a traditional custom of ancestor worship that set up the tomb of ancestors in the shrine and defended it. but most of the individuals who did not own their own forest had no choice but to install the tombs in the forests of others. For this reason, if we dismantle or destroy the original burials based on the ownership of the others, not only a great wave of societies will be expected, but also the traditional culture such as our old customs is reversed. In the meantime, the court has protected the grave by acknowledging the right to a graveyard similarity of the Surface Rights. However, the "Law of Funeral, etc." (hereinafter referred to as "Funeral Law" before and after the amendment) was enforced on January 13, 2001. Regarding the Graveyard after the enforcement of the Funeral Law, there was a change in the legal discipline of the graveyard by restricting the installation period of the tomb and strengthening the ownership of the land by stipulating that an acquisitive Prescription of the hereditary base was not recognized, and the fact that the hereditary rights have excessive restrictions on ownership of the landowners and hinder the efficient use of the land. Due to the increase of the cremation, traditional people 's consciousness about the way oder culture of the burial are changing. In the end, due to changes in the perception of society members about the graveyard and the change of the legal system such as the legal system on the cemetery, the conventional customary law on the acquisitive Prescription of the Right to a Graveyard is no longer in conformity with our legal system, so that it can not maintain its legal validity. The court ruling recognizes the possession of a permanent and free-of-graveyard prescription by virtue of the fact that even though there is no consent of the landowner, there has been a calm and concerted occupation for 20 years. However, the ruling is contradictory to the Supreme Court ruling that denies the prescription of ownership by unauthorized occupation. Thus, even if there is no consent of the landowner, the old custom of acknowledging the permanent and free acquisition of graveyard right contradicts the entire legal system including the Constitution, which respects private property rights, at least around January 1, 2001. So it lost its legitimacy and rationality. In addition, as the members of our society have no confidence in the legal binding power of these customs, they have lost their validity as legal norms. Therefore, in the case of a grave that has not yet passed its 20-year period on January 13, 2001, it can not claim the prescription of graveyard right. This is the same opinion as the minority opinion of the ruling. Through this paper, we expect to see a rapid change in case law.
